1. Agreement to Terms
By accessing or using the Plant Jivika website (https://plantjivika.com) or downloading, installing, or using the Plant Jivika mobile application (“App”, package com.plantjivika.app), you agree to be bound by these Terms and Conditions (“Terms”).
These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and the creators of Plant Jivika (“we,” “us,” or “our”). If you do not agree to these Terms, please do not access the website or use the App.
2. Description of the Service
Plant Jivika is an offline botanical companion and habit tracking application designed to help plant enthusiasts organize plant care routines (watering, misting, fertilizing, repotting) and maintain growth journals for houseplants and gardens.
- 100% Free & Local-First: The App provides its core tracking tools without mandatory subscription paywalls, advertising roadblocks, or mandatory cloud account sign-ups.
- Offline Functionality: Plant logging, routine calculation, and photo journaling operate locally in your device sandbox.
3. Informational & Botanical Disclaimer (Important)
A. General Guidance Only
All plant care recommendations, watering intervals, sunlight requirements, diagnostic tips, and botanical lore provided within the App or generated via AI assistant prompts are for general informational and educational purposes only. Plant care needs vary significantly based on microclimates, ambient humidity, seasonal weather, pot drainage, soil composition, and individual plant health.
B. Plant Health Disclaimer
We do not warrant or guarantee that following the schedules, diagnostics, or suggestions provided by the App will guarantee the survival, flourishing, or recovery of any plant. You are encouraged to inspect your plants and feel the soil before applying water or treatments.
C. Toxicity & Pet Safety Disclaimer
The App provides general toxicity classifications regarding common houseplants and their potential effects on pets (cats, dogs) and humans. This information is strictly educational and is not a substitute for professional veterinary or medical advice.
Emergency Ingestion Notice:
If you suspect that a child, pet, or individual has ingested a potentially toxic plant, contact your local poison control center, emergency healthcare provider, or emergency veterinary clinic immediately.
We disclaim all liability for adverse reactions, poisonings, injuries, or fatalities arising from reliance on plant toxicity information presented in the App.
4. User Responsibilities & Data Ownership
Device Storage & Backups: Because Plant Jivika is local-first, your plant logs and photographs are stored in your device's local application sandbox. You acknowledge that clearing app data, uninstalling the app, or resetting your device without external backups may permanently erase your stored plant history and photos. We are not responsible for lost data resulting from hardware failure, OS updates, or user deletion.
Photo Rights: You retain all ownership rights to any photographs you capture or import within the App. You represent and warrant that you have the right to photograph and store the content you record.
5. Acceptable Use
You agree not to:
- Attempt to decompile, reverse engineer, disassemble, or derive the source code of the App, except to the extent permitted by applicable open-source licenses.
- Use the App or website for any illegal, harmful, or unauthorized commercial exploitation.
- Interfere with or disrupt the security features of the App or its network endpoints.
- Submit false, malicious, or abusive reports through the in-app feature request and feedback forms.
6. Intellectual Property Rights
The design, brand name (“Plant Jivika”), logo, typography styling, custom graphics, user interface layouts, and software code are the intellectual property of Plant Jivika and its licensors and are protected by applicable copyright, trademark, and unfair competition laws. You are granted a personal, non-exclusive, non-transferable, revocable license to use the App on your personal devices in accordance with these Terms.
7. Third-Party Links & External Services
The App and website may contain links to third-party services (e.g., community channels on Instagram, Reddit, Discord, X/Twitter, or external AI platforms such as ChatGPT, Gemini, and Google Lens). We do not control and assume no responsibility for the content, privacy policies, practices, or availability of any third-party websites or services.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Plant Jivika, its developers, affiliates, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of plant life, botanical specimens, or crop yields;
- Veterinary or medical expenses related to plant toxicity or ingestion;
- Loss of data, journal records, or photographs;
- Device malfunction or storage corruption;
arising out of or in connection with your access to, reliance upon, or use of the App or website.
9. Disclaimer of Warranties
The App and website are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
10. Modifications to Terms
We reserve the right to modify or replace these Terms at any time. When updates are published, we will revise the “Last Updated” date at the top of this document. Continued use of the App or website following any changes indicates your acceptance of the updated Terms.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer operates, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through good-faith negotiation or competent courts of that jurisdiction.
